David A. Nakashima has represented companies and individuals in business and real estate disputes for over 30 years. He has successfully represented his clients in litigation in state and federal courts here in Hawai`i as well as in arbitration hearings and mediation.
Nakashima has been nationally recognized by Chambers USA as one of the Leading Lawyers for Business in Commercial Litigation in Hawai`i and a "Litigation Star" by Benchmark Litigation. Benchmark Litigation noted Nakashima is "recommended by his peers for his knowledge of corporate litigation areas like antitrust, securities fraud, mass tort disputes, professional liability, and RICO investigations." He was an adjunct professor at the William S. Richardson School of Law and has also contributed articles on business disputes to the leading Hawai`i business periodical, the Pacific Business News.
Representative Matters
- Successfully obtained an arbitration award of $3.2 million for general contractor/ co-developer on Big Island residential development. Also defeated a $35 million lost profit claim by the adverse party.
- Won a defense verdict in month-long securities fraud trial in federal court. Former shareholders had sought over $500 million in damages in the sale of one of the largest landholding companies in Hawai`i.
- Successfully defended a Hawai`i hotel chain against $17 million claim by former owner in a three member panel arbitration hearing.
- Recently vacated six-figure judgment against joint venture partner in a business dispute.
- Represented the successful party in the leading Hawai`i decision on corporate alter ego liability, Robert's Hawai`i School Bus, Inc. v. Laupahoehoe Transportation Company, Inc., 91 Hawai`i 224 (1994)
