Pele Defense Fund v. Paty, 73 Haw. 578, 837 P.2d 1247 (1992), cert. denied, U.S.(February 22, 1993). Successful defense of State-Campbell Estate geothermal land exchange from challenge under 5(f) land trust (Admission Act) and s. 1983 under precedent setting state sovereign immunity, statute of limitation, and collateral estoppel doctrines.
Ulaleo v. Paty, (D. Haw. 1989), 902 F.2d 1395 (9th Cir. May 4, 1990). Successful dismissal on Eleventh Amendment grounds of s. 1983 challenge to Campbell/State land exchange for geothermal development.
Dedman v. Board of Land and Natural Resources, 69 Haw. 255, 740 P.2d 28 (Haw. 1987), cert. denied, 485 U.S. 1020 (U.S. April 25, 1988) (No. 87-605). Successful defense of BLNR decisions designating geothermal subzones and granting development permits in Kahaualela and Kilauea Middle East Rift Zone, Puna, Hawaii. Four hearings (36 days). Co-authored all decisions. Testified in U.S. Senate and House on federal/state land issues related to Volcano National Park and geothermal.
Kanakaole, et al. vs. United States, Gov. John Waihee, (D. Haw. 89-00039), dismissal affirmed (9th Cir. 1992, CA 90-16686).
Puna Speaks v. Edwards, 554 F. Supp. 117 (D. Haw. 1982). Successful defense at trial of BLNR geothermal lease on environmental claims.
Robinson v. Ariyoshi, 696 F. Supp. 1022 (D. Haw. 1987); 887 F.2d 215 (9th Cir. 1989). Co-counsel on remand from U.S. Supreme Court, 477 U.S. 902 (1985). Successful dismissal on ripeness grounds of collateral attack in federal court of Hawai'i Supreme Court water rights decision McBryde v. Robinson on Fifth Amendment taking claim affecting Hanapepe River, Kauai, Hawai'i.
Hawai'i Water Code. Represented State and co-authored Hawai'i's water code (HRS Chap. 174C).
Hawai'i v. United States, 676 F. Supp. 1024 (D. Haw. 1988); 866 F.2d 313 (9th Cir. 1989). Quiet Title action to reestablish title to 1356 acres of Hawaiian Homes lands at Lualualei, Oahu, Hawai'i, illegally set aside by a Territorial governor's executive order. Worked with Western Attorney Generals on Federal Quiet Title Act amendments, 28 U.S.C. 2409a (1986). Hawaiian Homes Commission Act Oversight Hearings: U.S. Senate Energy and Natural Resource Committee (1992). U.S. Senate Select Committee on Indian Affairs Hearings (1989 and 1990).
In Re Banning, 73 Haw. 297, 832 P.2d 724 (1992) (Land Court App. 323). Successful defense of Hawai'i's accretion statute (HRS 501-33) although implied dedication doctrine rejected.
Koolau Agricultural Co. v. Commission on Water Resources Management, 76 Haw. 37, 868 P.2d 455 (1993). Challenge to Water Commission's designation of Windward Oahu groundwater under HRS chapter 174C successfully dismissed.
Kohala Corporation v. Callish, 69 Haw. 54, 732 P.2d 652 (Haw. 1987). Quiet Title (lost grant) claim at Mahukona I, North Kohala, Hawai'i. State obtained 18 acres ocean front land in settlement.
Higashionna v. Muss, (D. Haw. 1986); Ono v. Harper, 592 F. Supp. 698 (D. Haw. 1983). Successful State challenge to General Services Administration sale of surplus federal land at Honolulu International Airport and challenge to federal land sales at Makakilo and Maile, Oahu.
Mounier v. Kruse, (U.S.D.C. Haw. 1985) and State Court (1986). Successful defense of State's fishing regulations in northwest Hawaiian islands and dismissal of challenge to archipelagic (interchannel waters) claim.
Akau v. Olohana, 65 Haw. 383, 652 P.2d 1130 (1983). Successfully established private right of action for protection of public access rights.
Barba v. Okuna, 65 Haw. 680, (1982). Successfully established public access at Kawa Bay, Kau, Hawai'i, on the basis of prescription, custom, dedication, reservation, and necessity.
Neighborhood Board No. 24 v. State Land Use Commission, 64 Haw. 265, 639 P.2d 1097 (1982). Successfully established standards for district boundary amendments by rejecting special use permit for 103 acre amusement park on agricultural land at Kahe Point, Oahu.
Hunter v. Hirata, U.S.D.C. (Haw. 1979). Successful class action establishing due process standards in public utility (water) terminations.
U.S. Department of Interior's Federal/State Task Force Task Force oversaw preparation of Environmental Impact Statement on proposed Manganese Crust Mining in Hawaii's Exclusive Economic Zone (1985-present); counsel to Hawai'i's EEZ Working Committee.
Hawaii's Federal Land Task Force (1982-86) Acquisition of Piers 39 & 40 (Honolulu Harbor) from U.S. Oahu: Hickam Annex (3.4 acres); Ruger (16 acres); Waianae-Kai (4 acres); Lualualei (647 acres); Sand Island (4 acres); Makapuu (38 acres); Waiawa (108 acres); Kaena Point (85 acres); on the island of Hawai'i: South Point (5.3 acres); Cape Kumakahi (58 acres); on Kauai: Nawiliwili (3 acres); Hanapepe (11 acres).
Amendments to: Haw. Rev. Stat. 501-33 and 669-1(e) (accretion); Hawaii Constitution, Article XI, section 11 (Exclusive Economic Zone); Act 126, SLH 1990 (Hawaii's Territorial Sea); Act 325, SLH 1991 (HHCA water rights).
